Terms of Service

Ole Brook Web Services, LLC (“OBWS,” “we,” “us”) provides website builds, managed hosting/care plans, and OBWS Insights reporting. By using our website or services, you agree to the terms below.

1. Eligibility and acceptable use

  • You may use our website and services for lawful purposes only.
  • You must not attempt to disrupt our systems, probe or scan for vulnerabilities, or misuse forms and contact channels for spam.
  • If we host your site, you are responsible for the legality of your content and for obtaining rights to any content you provide to us.

2. Service scope

Service details, pricing, and deliverables are defined by your proposal, invoice, or written agreement. If there’s a conflict between those documents and these terms, the written agreement controls for that engagement.

3. Websites, hosting, and technical services

  • All ongoing hosting we provide for client websites is bundled with an active care plan; we do not offer standalone hosting without a maintenance plan.
  • Essential Care applies to static sites deployed on our shared hosting cluster. Dynamic or CMS-based hosting (for example, WordPress or custom applications) requires separate arrangements at higher monthly rates.
  • Care plans are billed month-to-month. Pricing and inclusions may be updated over time to reflect scope and vendor costs. Any changes for existing clients will be communicated in advance.
  • Maintenance, updates, and changes are handled according to the plan and any included monthly hours (if applicable).

4. Domain registration and transfers

  • For clients on an active care plan, we may register or manage domain names on your behalf. Subject to applicable registry rules and your payment of all amounts due, you retain the benefit of those registrations and may request a transfer to another registrar or provider.
  • You are responsible for all third-party costs associated with any transfer, including transfer and renewal fees charged by the gaining registrar or registry.
  • We may charge a reasonable administrative fee for assisting with a transfer, which will be disclosed to you in advance.
  • We will not unreasonably withhold, condition, or delay a transfer request, provided your account is in good standing and the domain is eligible for transfer under applicable rules.
  • After the domain is transferred away, we are not responsible for DNS configuration, website availability, or email routing at the new provider.

5. OBWS Insights

OBWS Insights is a managed reporting add-on. When enabled, it provides a client-facing dashboard and campaign tracking features (including link tracking and tracking pixels) for approved sites under your plan.

Insights is intended to support marketing visibility, performance reviews, and improvement planning. You’re responsible for ensuring you have the right to track and analyze your site’s traffic and campaigns.

6. Service availability

Our services are provided on a best-effort basis unless a separate written agreement states otherwise. Outages, maintenance windows, vendor incidents, and changes may occur.

7. No warranties; limitation of liability

OLE BROOK WEB SERVICES IS PROVIDED “AS IS” AND “AS AVAILABLE.” WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES ARISING FROM YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID TO OBWS FOR THE SERVICE GIVING RISE TO THE CLAIM DURING THE 3 MONTHS BEFORE THE EVENT.

8. Termination

We may suspend or terminate access if we believe you are abusing the service, violating these terms, or creating risk for other clients or infrastructure. You may stop using OBWS services by discontinuing the relevant service, subject to any outstanding invoices or written commitments.

9. Privacy

Our handling of information is described in the Privacy Policy. By using OBWS you consent to that policy.

10. Governing law

These terms are governed by the laws of the State of Mississippi, without regard to conflict-of-law principles.

11. Changes to these terms

We may modify these terms at any time without notice. It is your responsibility to review them periodically. Your continued use of Ole Brook Web Services after changes take effect constitutes acceptance of the updated terms.
